This website is operated by Asphalt Apparel. Throughout this document, the terms "we," "us," and "our" refer to Asphalt Apparel. Asphalt Apparel is powered by Shopify, which enables us to provide our services to you.

By visiting our site and placing an order, you agree to be bound by the following Terms of Service, including all additional policies referenced herein. Please read these Terms carefully. If you do not agree, please refrain from using our store.

If there is a conflict between these Terms of Service and our Privacy Policy, the Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

2. Our Role as a Retail Intermediary

Asphalt Apparel operates as a retail intermediary and authorised sales agent between independent manufacturers and suppliers based primarily in China, and the end customer. We curate, list, and facilitate the sale of products on behalf of our supplier partners, who are responsible for the production and physical fulfilment of each order.

Our supplier platforms are technically accessible to the public; however, they are designed primarily for the domestic Chinese market and present significant practical barriers to the average South African or international buyer. These barriers include platforms operating exclusively in Mandarin Chinese, payment systems that require a Chinese bank account or locally issued payment credentials, and logistical infrastructure not configured for direct international shipping. Accessing, navigating, sourcing, and purchasing from these platforms independently requires a level of technical and linguistic familiarity that is not reasonably available to most consumers outside of China.

Asphalt Apparel bridges this gap by assuming full responsibility for supplier communication, product sourcing, payment processing, and order coordination — providing customers with straightforward, accessible access to products that would otherwise be practically out of reach.

By placing an order with us, you are entering into a sales agreement with Asphalt Apparel. We act as the responsible agent for that transaction and take full accountability for ensuring your order is fulfilled as described.

3. Product Information

We are committed to providing accurate and detailed product descriptions, including:

Product specifications, materials, and dimensions where applicable
Photography representative of the actual item
Sizing guides and fit information
Material composition and care instructions

While we make every effort to ensure accuracy, minor variations in colour may occur due to screen display differences. We reserve the right to correct errors or update product information at any time.

4. Orders and Payment

By placing an order, you confirm that:

All personal, billing, and delivery information provided is accurate and current
Full payment is required at the time of purchase. We do not offer deferred payment, "buy now, pay later," or instalment options
You have the legal capacity to enter into this agreement

We reserve the right to refuse or cancel any order at our sole discretion, including in cases of suspected fraud, inaccurate information, or product unavailability. Should an order be cancelled after payment, a full refund will be issued promptly.

5. Delivery and Fulfilment

As a retail intermediary, orders are fulfilled and dispatched by our supplier partners directly to your shipping address. A clearly defined delivery window is stated on each product listing and confirmed at checkout.

International shipping is not available at this time. We will update this page and notify customers once international fulfilment has been confirmed and is operational.

While we are unable to guarantee a specific calendar date of delivery due to variables within international logistics, customs clearance, and carrier capacity, we commit to the delivery window communicated at the point of purchase. These windows are provided in good faith based on our fulfilment partner's shipping estimates from supplier warehouses in China to South Africa. Asphalt Apparel accepts responsibility for ensuring delivery falls within the stated timeframe and will actively manage any delays or fulfilment issues on your behalf.

Once an order has been dispatched, a confirmation and tracking reference will be sent to the email address provided at checkout.

6. Returns, Refunds, and Disputes

We stand behind every product sold through Asphalt Apparel. If your item arrives damaged, defective, or significantly different from its description, you are entitled to a full refund or replacement.

To raise a concern, please contact us within 7 days of receiving your order at asphaltapparelstore@gmail.com.

We do not accept returns for items that have been worn, washed, or altered unless the item was received in a faulty condition.

Refunds, where approved, will be processed within 10 business days to your original payment method. Processing times may vary depending on your bank or payment provider.

7. Limitation of Liability

Asphalt Apparel's liability is limited to the value of the order placed. We are not liable for indirect losses, delays caused by third-party logistics providers beyond our control, or losses resulting from incorrect delivery information provided by the customer.

8. Intellectual Property

All content on this website — including brand name, logo, product photography, and written copy — is the property of Asphalt Apparel or used with permission. Reproduction or commercial use without written consent is prohibited.

9. Privacy and Personal Information

Your personal information is collected and processed in accordance with our Privacy Policy, which forms part of these Terms. By using our Services, you acknowledge that you have read and understood our Privacy Policy.

In summary, we collect personal information to fulfil orders, process payments, arrange shipping, provide customer support, and improve our Services. This includes contact details, financial information, account information, transaction history, and device/usage data.

We may share your information with Shopify and trusted third-party service providers (such as payment processors and fulfilment partners) solely to provide our Services. We do not sell your personal information to unrelated third parties.
